FairWhere?

Terms of Use

Last updated October 7, 2026

These terms are an agreement between you and Sunny Simms Inc. ("we") for using FairWhere. By creating an account or using the app you agree to them. If you don't agree, don't use FairWhere.

Your account

You need to be at least 13 to use FairWhere. Keep your sign-in secure, and give accurate information. You can delete your account at any time in the app (Me → Delete account).

Sharing your round and location

When you start sharing a round, the people you choose can see which hole you're on and your estimated finish while the round is live. Location is used only during a round you're sharing and stops when the round ends. Only share with people you trust, and only share someone else's whereabouts with their permission.

Acceptable use: zero tolerance

You may not post or send anything that is abusive, harassing, hateful, sexually explicit, violent, threatening, or illegal, including in your name, @username or photo. Don't impersonate others, spam, or use FairWhere to track anyone without their consent. We have zero tolerance for objectionable content or abusive users.

You can report or block anyone from their page in the app. We review reports within 24 hours and will remove offending content and remove accounts that break these rules.

Estimates and golf data

Hole detection, yardages, finish times and pace are estimates based on GPS and community map data (OpenStreetMap), and can be wrong. Don't rely on FairWhere for safety or emergencies, and pay attention to your surroundings on the course.

Your content

You keep ownership of what you put in FairWhere (like your photo and scores). You give us permission to store and show it to the people you share it with, only to run the app.

Availability and changes

We may change, pause or stop parts of FairWhere. We'll update these terms when needed and change the date above; continuing to use the app means you accept the new terms.

Disclaimers and liability

FairWhere is provided "as is" without warranties of any kind. To the extent the law allows, we aren't liable for indirect or consequential damages, or for any loss arising from use of the app, and our total liability is limited to $50.

Apple

These terms are between you and Sunny Simms Inc., not Apple. Apple isn't responsible for FairWhere or its content, has no obligation to provide support for it, and is a third-party beneficiary of these terms with the right to enforce them.

Law

These terms are governed by the laws of the State of California.
